Rental Contract #06242021 RENTAL ONLY PROGRAM - This is a Rental Only Program, meaning that the instrument you are renting will not be owned by the renter regardless of the amount of months rented. RETURN OF THE RENTAL - Once instrument is returned to Blue Note B"s Horn Shop the contract is terminated and all rental payments are no longer applicable to transfer for an upgrade. RESPONSIBILITY FOR LOSS/DAMAGE - As the Renter you are responsible for the rental instrument for the duration of your rental until it comes back to our store as a rental return. That means that if the instrument is stolen, damaged purposefully or damaged beyond repair (for example being left behind your car and being driven over - it has happened!) you are responsible to let us know within 14 days of the occurrence and we will set up payment arrangements with you to cover the instrument repayment. This will be a total of $750. Equity cannot be used. UPGRADE OPTION - Renter, with account in good standing, has option to upgrade to a tier 1 upgrade option. Renter can use the equity of their payments up to the value of the tier 1 upgraded instrument. If the renter has paid more than the value of the instrument, only the tier 1 instrument value can be transferred & the extra money will not be transferable. If Renter has multiple rentals, the equity cannot be combined. SIMPLE AUTOMATIC PAYMENTS - During time of rental we take your credit card information and set up an auto payment. You have the flexibility to choose what day of the month you would like the payment deducted. UPDATED CREDIT CARD INFORMATION - If you get a new credit card in the mail or change payment information give us a call at 775-453-9219. DECLINED CREDIT CARD PAYMENTS - If your payment declines for the month we will give you a courtesy call to update your payment. If payments are not updated after 30 days of the initial decline we add a $5 per week fee. After 3 months non payment the account is sent to a third party collection service. If account is delinquent, you authorize us and our representatives to pick up the instrument from school or any other mutually designated location.

RENTAL MAINTENANCE PROGRAM - A $20.00 processing and parts fee is due at post maintenance pick up of instrument. The Rental Maintenance Program covers all normal "wear & tear" & standard maintenance of rental instrument. Only Blue Note B"s Horn Shop LLC will make all appropriate repairs & adjustments to keep the equipment in proper playing condition. RENTAL INSTRUMENT ABUSE - This includes willful damage, or careless handling of rental instrument. It also includes incorrect cleanings (usage of unapproved chemicals - approved care kits sold in store). RENTAL REPAIRS - Renter, do not use tools at home on these instruments! Renter is not permitted to bring instrument to any other repair technician or company. If instrument is repaired at unapproved location then Renter must pay full repair price to restore instrument back to it"s original rental condition. CREDIT CARD AUTHORIZATION - By Signing this Contract, Renter allows Blue Note B"s Horn Shop: 1.) Charge the card on file on the agreed day of each month 2.) Charge amount is the Total Monthly Rental Amount 3.) Charge account until instrument is returned 4.) Renter allows Blue Note B"s Horn Shop to make multiple attempts to recover the payment using the card on file, regardless of agreed day to charge card. 5.) Renter agrees that if payments are in default, multiple charges may go through in the same month in order to collect on "back" rents due. 6.) Cardholder is responsible for updating Blue Note B"s Horn Shop with updated card information should their card number be changed. LEGAL STUFF TO NOTE - This rental agreement constitutes the entire agreement between Renter and Blue Note B"s Horn Shop LLC, and shall not be amended, altered, or changed except by thirty (30) days written notice from Blue Note B"s Horn Shop LLC. Time is of the essence.

The parties hereto agree that all actions or proceedings arising in connection with this Agreement shall be tried and litigated exclusively in the State and Federal courts located in the County of Washoe, State of Nevada. Each party hereby waives any right it may have to assert the doctrine of forum non conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with the paragraph, and stipulates that the State and Federal courts located in the County of Washoe, State of Nevada shall have in personam jurisdiction and venue over each of them for the purpose of litigating any dispute, controversy, or proceeding arising out of or related to this Agreement. Any final judgment rendered against a party in any action or proceeding shall be conclusive as to the subject of such final judgment and may be enforced in other jurisdictions in any manner provided by law. IF YOU PROCEED WITH PAYMENT YOU ARE AGREEING TO THESE TERMS. I acknowledge I am renting this property. I will not own this instrument . I understand there is a 2 month minimum and I do not have the right to keep the property regardless of how many payments I make. I understand and agree Blue Note B"s Horn Shop LLC may repossess the property if I fail to make rental payments as scheduled. I can only transfer equity up to the value of a tier 1 instrument. If I return this instrument without upgrading then I will surrender all equity available immediately. If I fail to make a payment after 90 days, this contract will go to collections for the full value of the instrument (no less than $750.00) & I will be responsible for all Collection fees incurred from Blue Note B"s Horn Shop. I understand this may be above the value of the instrument price after all fees are added to the total collection amount due.
